Welcome to XRayTrade. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By subscribing to, accessing, or using XRayTrade indicators, software, or services ("Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Description of Services

XRayTrade provides trading indicators and analysis tools for use on supported platforms including TradingView and NinjaTrader. Our Services include:

• Access to proprietary trading indicators
• Software updates and new feature releases
• Customer support
• Educational materials and documentation

3. Subscription and Payment

Pricing: Current subscription options are Monthly ($39/month), Annual ($349/year), and Lifetime ($897 one-time payment). Prices are subject to change with notice to existing subscribers.

Billing: Monthly and annual subscriptions are billed automatically at the start of each billing period. You authorize us to charge your payment method on file.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

Lifetime Access: Lifetime subscriptions provide perpetual access to all current and future indicators for as long as XRayTrade remains in operation.

4. License and Usage

Upon payment, you are granted a non-exclusive, non-transferable, personal license to use XRayTrade indicators on your own trading accounts. You may NOT:

• Share, distribute, or resell access to your account
• Reverse engineer, decompile, or attempt to extract source code
• Use the indicators for commercial purposes beyond personal trading
• Create derivative works based on our indicators
• Share screenshots or recordings that reveal proprietary methodology

5. Partner Program

Participants in the XRayTrade Partner Program agree to the following:

• Commissions: 25% recurring on Tier 1 (direct) referrals, 10% recurring on Tier 2 referrals
• Duration: Commissions are paid for the lifetime of referred subscriptions
• Payment: Monthly payouts via PayPal or bank transfer, minimum $50 threshold
• Conduct: Partners must not make false claims, guarantee profits, or use spam/misleading advertising
• Termination: We reserve the right to terminate partner accounts for violations of these terms

6. No Financial Advice

XRayTrade provides technical analysis tools only. We do NOT provide:

• Investment advice
• Trading recommendations
• Guarantees of profit or performance
• Personalized financial guidance

All trading decisions are your own responsibility. Past performance of any indicator or strategy is not indicative of future results.

7. Risk Acknowledgment

By using our Services, you acknowledge that:

• Trading involves substantial risk of loss
• You may lose more than your initial investment
• No indicator or system can guarantee profits
• You are solely responsible for your trading decisions

8. Intellectual Property

All XRayTrade indicators, code, designs, documentation, and branding are the exclusive property of XRayTrade and are protected by intellectual property laws. Your subscription grants a license to use, not ownership of, our intellectual property.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XRAYTRADE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, OR DATA LOSS, ARISING FROM YOUR USE OF OUR SERVICES.

Our total liability shall not exceed the amount you paid for Services in the 12 months preceding the claim.

10. Disclaimer of Warranties

Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that Services will be uninterrupted, error-free, or meet your specific requirements.

11. Account Termination

We reserve the right to suspend or terminate your account for:

• Violation of these Terms
• Fraudulent or illegal activity
• Sharing account access with others
• Abusive behavior toward staff or other users

12. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email to active subscribers. Continued use after changes constitutes acceptance of updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration.
